Terms and conditions of sale

Article 1 - Purpose

These terms govern sales made by the company Harmonia (through its All Cool site), located at 54 Avenue de la Meridienne, 48100 Marvejols, France.

Article 2 - Prices

The prices of our products are shown in euros, inclusive of all taxes (VAT and other taxes applicable on the day of the order), unless stated otherwise and excluding handling and shipping costs.
For an order shipped to a country other than mainland France, you are the importer of the product or products concerned. Customs duties or other local taxes, import duties or state taxes may be payable. These duties and sums are not within the remit of Harmonia. They are payable by you and are entirely your responsibility, both in terms of declarations and of payments to the relevant authorities and bodies in your country. We advise you to check these matters with your local authorities.
All orders, whatever their origin, are payable in euros.
Harmonia reserves the right to change its prices at any time, but the product will be invoiced at the rate in force at the time the order is confirmed, subject to availability.
Products remain the property of Harmonia until the price has been paid in full.
Please note: as soon as you take physical possession of the products ordered, the risk of loss or damage to the products passes to you.

Contractual information is presented in English and will be confirmed at the latest when your order is validated.
Harmonia reserves the right not to record a payment, and not to confirm an order, for any reason whatsoever, and in particular in the event of a supply problem or of a difficulty concerning the order received.

Article 4 - Validation of your order

Any order placed on the website https://www.all-cool.net implies acceptance of these General Terms. Any order confirmation entails your full and unreserved acceptance of these general terms and conditions of sale, without exception or reservation. All the data provided and the recorded confirmation will stand as proof of the transaction.
You declare that you are fully aware of this.
Order confirmation will stand as a signature and as acceptance of the transactions carried out.
A summary of your order information and of these General Terms will be sent to you in PDF format via the order confirmation email.

Article 5 - Payment

Validating your order means you are obliged to pay the price shown. Payment for your purchases is made by bank card through the secure PayPal system.
The card is only debited when the order is dispatched. In the event of split deliveries, only the products shipped are debited.

Article 6 - Right of withdrawal

In accordance with the provisions of article L.121-21 of the French Consumer Code, you have a withdrawal period of 14 days from receipt of your products to exercise your right of withdrawal, without having to give reasons or pay a penalty.
Returns must be made in their original condition and complete (packaging, accessories, instructions). You are responsible for this. Any damage suffered by the product on this occasion may defeat the right of withdrawal.
Return costs are payable by you.
If the right of withdrawal is exercised, Harmonia will refund the sums paid within 14 days of being notified of your request, using the same means of payment as that used for the order.

Exceptions to the right of withdrawal:
In accordance with the provisions of article L.121-21-8 of the French Consumer Code, the right of withdrawal does not apply to:
The supply of services fully performed before the end of the withdrawal period and whose performance began after the consumer's express prior agreement and express waiver of their right of withdrawal. The supply of goods or services whose price depends on fluctuations in the financial market beyond the trader's control and which may occur during the withdrawal period. The supply of goods made to the consumer's specifications or clearly personalised. The supply of goods liable to deteriorate or expire rapidly. The supply of goods unsealed by the consumer after delivery which cannot be returned for reasons of hygiene or health protection. The supply of goods which, after delivery and by their nature, are inseparably mixed with other items. The supply of alcoholic drinks whose delivery is deferred beyond thirty days and whose value agreed at the conclusion of the contract depends on market fluctuations beyond the trader's control. The supply of audio or video recordings or of computer software unsealed by the consumer after delivery. The supply of a newspaper, periodical or magazine, except for subscription contracts for such publications. Transactions concluded at a public auction. The supply of digital content not provided on a tangible medium whose performance began after the consumer's express prior agreement and express waiver of their right of withdrawal.

Article 7 - Availability

Our products are offered for as long as they are visible on the site https://www.all-cool.net and while stocks last. For products not held in stock, our offers are valid subject to availability from our suppliers. If a product is unavailable after you have placed your order, we will inform you by email. Your order will be cancelled automatically and no payment will be taken.
Furthermore, the website https://www.all-cool.net is not intended to sell its products in large quantities. Consequently Harmonia reserves the right to refuse orders for multiple identical items.

Article 8 - Delivery

Products are delivered to the delivery address given during the ordering process, within the time indicated on the order confirmation page.
In the event of a dispatch delay, an email will be sent to inform you of any consequences for the delivery time indicated to you.
In accordance with the legal provisions, in the event of a delivery delay you have the option of cancelling the order under the conditions and terms set out in article L 138-2 of the French Consumer Code. If in the meantime you receive the product, we will refund it and the shipping costs under the conditions of article L 138-3 of the French Consumer Code.
Where delivery is made by a carrier, Harmonia cannot be held responsible for a delivery delay caused solely by the customer's unavailability after several proposed appointments.

Article 9 - Warranty

All our products benefit from the legal warranty of conformity and the warranty against hidden defects, provided for by articles 1641 and following of the French Civil Code. If a product sold is not compliant, it may be returned, exchanged or refunded.
All claims and requests for exchange or refund must be made by email within 30 days of delivery.
Products must be returned to us in the condition in which you received them, with all their elements (accessories, packaging, instructions and so on). Shipping costs will be refunded on the basis of the amount invoiced, and return costs will be refunded on presentation of receipts.
The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in article 6.

Article 10 - Liability

The products offered comply with the French legislation in force. Harmonia cannot be held liable for non-compliance with the legislation of the country to which the product is delivered. It is for you to check with the local authorities whether the products or services you intend to order can be imported or used.
Furthermore, Harmonia cannot be held liable for damage resulting from improper use of the product purchased.
Finally, Harmonia cannot be held liable for any inconvenience or damage inherent in the use of the internet, in particular a service interruption, an external intrusion or the presence of computer viruses.

Article 11 - Applicable law in the event of a dispute

The language of this contract is French. These terms of sale are governed by French law. In the event of a dispute, the French courts alone have jurisdiction.

Article 12 - Intellectual property

All the elements of the site https://www.all-cool.net are and remain the exclusive intellectual property of Harmonia. No one is authorised to reproduce, exploit, redistribute or use in any way whatsoever, even partially, any elements of the site, whether software, visual or audio. Any link, simple or hypertext, is strictly prohibited without the express written or email agreement of Harmonia.

Article 13 - Personal data

Harmonia reserves the right to collect identifying information and personal data concerning you. It is necessary for the management of your order, and to improve the services and information we send you.
It may also be passed to the companies that contribute to those relations, such as those responsible for carrying out the services and orders, for their management, execution, processing and payment.
This information and data is also retained for security purposes, in order to comply with legal and regulatory obligations.
In accordance with the French law of 6 January 1978, you have a right of access, rectification and objection regarding the identifying information and personal data concerning you, directly on the website.

Article 14 - Archiving and proof

Harmonia will archive order forms and invoices on a reliable and durable medium constituting a faithful copy, in accordance with the provisions of article 1348 of the French Civil Code. The computerised records of Harmonia will be considered by all parties concerned as proof of the communications, orders, payments and transactions between the parties.
